Welcome to QB Data Service! These Terms & Conditions (“Agreement”) govern your access and use of our services, including data recovery, migration, software support, and other technical assistance for various accounting programs. By purchasing our services, you agree to be bound by these terms.


1. DEFINITIONS

For the purposes of this Agreement:

  • “Company” refers to QB Data Service.
  • “Customer” or “You” refers to any individual or business that purchases or uses our services.
  • “Service” refers to all data-related and software support services provided by QB Data Service.

2. SERVICE SCOPE & LIMITATIONS

  • QB Data Service provides remote support for data recovery, migration, third-party software assistance, and accounting software installation.
  • Our services are limited to one (1) device per customer unless otherwise specified.
  • Customers must meet the minimum system requirements for our services, including a stable internet connection and up-to-date antivirus software.
  • No Guarantees: While we strive for the best results, QB Data Service does not guarantee that all data recovery or migration services will be 100% successful due to system limitations or customer errors.

3. PAYMENT & BILLING

  • All service fees are non-refundable, except under the terms outlined in our Refund Policy.
  • Customers may purchase services for a one-time fee or on a subscription basis (one, two, or three years).
  • Subscription renewals are billed automatically unless the customer opts out before renewal.
  • QB Data Service reserves the right to modify pricing with prior notice.

4. CANCELLATION & REFUND POLICY

  • Customers must cancel before renewal to avoid automatic billing.
  • Refunds are only issued if the primary issue remains unresolved, as outlined in our Refund Policy.

5. CUSTOMER RESPONSIBILITIES

  • Customers must provide accurate information for payment processing and service delivery.
  • Customers must cooperate with QB Data Service agents during remote sessions to troubleshoot or resolve issues.
  • Any unauthorized modifications or third-party interventions on customer devices after service completion may void any claims for service dissatisfaction.

6. LIMITATION OF LIABILITY

QB Data Service is not responsible for:

  • Any loss of data beyond what is recoverable using industry-standard methods.
  • Any hardware failure, system corruption, or third-party software conflicts affecting service performance.
  • Any financial or business loss arising from delays, errors, or system issues related to accounting programs or third-party software.

๐Ÿ“Œ Maximum Liability: QB Data Serviceโ€™s liability shall not exceed the total amount paid for the service in question.


7. ACCOUNT & DATA SECURITY

  • Customers are responsible for maintaining the security of their login credentials and sensitive business data.
  • QB Data Service does not store customer credit card details after payment processing.
  • Any unauthorized access or security breach must be reported immediately to support@qbdataservice.com.

8. SERVICE TERMINATION & REFUSAL

QB Data Service reserves the right to terminate service without a refund if:
โŒ The customer engages in fraudulent activities or provides false information.
โŒ The customer violates our Terms & Conditions or engages in abusive behavior.
โŒ The requested service falls outside our expertise or cannot be reasonably completed.


9. INTELLECTUAL PROPERTY RIGHTS

  • All QB Data Service content, materials, website content, and technical solutions are intellectual property of QB Data Service.
  • Customers may not reproduce, distribute, or modify any QB Data Service materials without prior written consent.

10. GOVERNING LAW & DISPUTE RESOLUTION

  • These Terms & Conditions are governed by the laws of the United States.
  • In case of a dispute, both parties agree to resolve issues through mediation first before pursuing legal action.
  • Any unresolved disputes shall be handled in a court of competent jurisdiction in the customerโ€™s region.
